Terms and Conditions of Service
ReachOut Wireless™ is
a service provided by Nexus Communications, Inc., ("Nexus").
Pursuant
to regulations of the Federal Communications Commission ("FCC"),
Link-Up support is no longer available effective April 1, 2012.
Nexus
will check the eligibility of low-income consumers seeking to enroll in the
Lifeline program either by accessing electronic databases, where available, or
by reviewing documentation from the consumer demonstrating his or her
eligibility for Lifeline benefits.
Acceptable
documentation of program based eligibility includes: (1) the
current or prior year's statement of benefits from a qualifying state, federal
or Tribal program; (2) a notice letter of participation in a qualifying state,
federal or Tribal program; (3) program participation documents (e.g., the
consumer's Supplemental Nutrition Assistance Program (SNAP) electronic benefit
transfer card or Medicaid participation card (or copy thereof if the Lifeline
applicants name is clearly visible); (4) another official document evidencing
the consumer's participation in a qualifying state, federal or Tribal program.
Acceptable
documentation of income based eligibility includes the prior
year's state, federal, or Tribal tax return, current income statement from an
employer or paycheck stub, a Social Security statement of benefits, a Veterans
Administration statement of benefits, a retirement/pension statement of
benefits, an Unemployment/Workmen's Compensation statement of benefits, federal
or Tribal notice letter of participation in General Assistance, or a divorce
decree, child support award, or other official document containing income
information.
All ReachOut Wireless™
Lifeline applicants will be required to certify upon enrollment that the
subscriber's household is receiving no more than one Lifeline-supported
service.
BE
ADVISED THAT TRANSFERRING, RENTING, OR SELLING A ReachOut Wireless™
LIFELINE HANDSET AND/OR WIRELESS SERVICES IS A VIOLATION OF FEDERAL AND
STATE LAW.
Existing
NEXUS COMMUNICATIONS, INC., DBA ReachOut Wireless™
tariffs govern the Services. Tariffs that are officially on file with the
various state public utilities commissions and the FCC supersede any terms
related to the Services.
NEXUS
COMMUNICATIONS, INC., DBA ReachOut Wireless™ may from
time to time offer access through its website for users to obtain access to
tariffs which are officially on file with the various state public utilities
commissions and the FCC. However, users who access tariffs online should be
aware that the documents accessible through the website herein may not be the
official documents and users assume sole responsibility for any reliance on the
tariffs available through this website. NEXUS COMMUNICATIONS, INC., DBA ReachOut Wireless™
bears no responsibility or liability for the accuracy of documents available
through this website.
The
following ReachOut Wireless™ Terms and Conditions of Service contains extremely
important information about your rights as a subscriber, and by qualifying
and/or enrolling in the ReachOut Wireless™ service (or
Service) and/or by accepting delivery and/or making a call on your ReachOut Wireless™
or using your ReachOut Wireless™ phone after you make a change to your account, you
are agreeing to the following Terms and Conditions of service and the following
Terms and Conditions of Service are a legally binding agreement between you as
the subscriber and Nexus; ReachOut Wireless™ service
requires: (1) eligibility for Lifeline; and (2) residence within the Coverage
Area.
Coverage
Area: The only way to conclusively determine if ReachOut Wireless™
provides wireless service in your area is to input your zip code into the ReachOut Wireless™
website found at www.Reachoutmobile.com.
The ReachOut Wireless™ map depicts an approximation of outdoor coverage.
Actual coverage area may differ substantially from the area shown on the map,
as coverage may be affected by terrain, weather, foliage, buildings and other
construction, signal strength, customer equipment and other factors. ReachOut Wireless™
does not guarantee coverage or network availability. Charges will be based on
the location of the site receiving and transmitting the call, not your
location. Rates apply to calls to and from the ReachOut Wireless™
Coverage Area.
Taxes/Surcharges: ReachOut Wireless™
subscribers are solely responsible for paying all charges including, but not
limited to all applicable surcharges, fees, taxes, and regulatory
charges. ReachOut Wireless™ subscribers are responsible for all charges
applicable to Customer handset service, whether or not Customer was the user of
the wireless phone.ReachOut Wireless™ will automatically deduct applicable all
applicable surcharges, fees, taxes, and regulatory charges from the Customer's
available minutes. Changes to a surcharge, fee or tax will become effective as
provided by the taxing authority and change to applicable contribution amounts
for the Federal Universal Service Fund ("FUSF"). Other regulatory
charges may become effective immediately. Additional taxes and other fees: In
many jurisdictions, certain recurring fees or taxes will be debited from your
account balance as allowed by law. Other taxes, surcharges and fees apply on
top of refill denominations or other airtime purchases.
No
wireless minutes will be deducted nor will any toll charges apply when a
subscribers dials #611 to speak with ReachOut Wireless™
customer service representatives; minutes will be deducted for all other calls
to ReachOut Wireless™ customer service.
ReachOut Wireless™
subscribers have the option of requesting a copy of their paper bill. All
requests for a copy of paper bill paper bill can be submitted in writing via
mail or via fax. Subscribers can also verbally request a paper bill as long as they
can provide ReachOutWireless™ with proper account information to verify that are
indeed the account holder on record.

If money/value/airtime is added to your ReachOut Wireless™
account before the current balance expires, the existing balance will carry
over to the new expiration date. Any unused account balance is forfeited upon
expiration or termination of eligibility in the ReachOutWireless™
program.
Per
Minute Rates: Airtime, when used for standard voice usage cellular calls,
is valued at and will be decremented at $0.20 per minute of use . Airtime
charges and domestic long distance charges apply to forwarded/transferred calls
even in the event the call is sent to a wireline telephone. Airtime charges
apply to all calls simultaneously, and airtime charges apply to message
retrieval.
Directory
Assistance is $1.50 plus standard airtime rates.
Operator
Assistance is available by dialing *611.
ReachOut Wireless™
voice usage is deducted in full-minute increments with partial minutes rounded
up to the next full minute at the end of each call. No credit is given for
dropped calls.
ReachOut Wireless™
plan minutes will be depleted for per-minute charges (and/or, where applicable,
access fees) apply to calls made using features including Call Waiting, Call
Forwarding, Three-Way Calling and voicemail retrievals.
ReachOut Wireless™
calling features include Call Waiting, Call Forwarding, Three-Way Calling and
voicemail retrievals.
Caller
ID: Your billing name may be displayed along with your wireless number on
outbound calls to other wireless and landline phones with Caller ID
capability ReachOut Wireless™ accounts do not have the ability to block the
display of your name and number.
Roaming
Usage: Per minute usage on ReachOut Wireless™
accounts while Roaming deduct at $0.59 per minute of use. Roaming charges are
applicable in addition to standard usage charges and are automatically deducted
from your balance of available minutes. A Roaming occurs when a ReachOut Wireless™
subscriber due to the physical location of the handset, uses the facilities of
another wireless service provider. Roaming occurs when you make and receive
calls outside your home calling area. Availability, quality of coverage and
services while roaming are not guaranteed.
Domestic
Text Messages: The rates to send or receive a text message to another person's
phone using your ReachOut Wireless™ handset are charged one minute of airtime for most
plans (two minutes for the 68 minute plan). If you do not want minutes/units
deducted from your ReachOut Wireless™ phone, then do not send a text message and/or do
not open any incoming text messages. Each message is limited to 160 characters.
International
Text Messages: The rates to send or receive an international text message to
another person's phone using your ReachOut Wireless™
handset are $0.20 per text message sent and $0.20 per text message received. If
you do not want minutes/units deducted from your ReachOut Wireless™
™ phone, then do not send a text message and/or do not open any incoming text
messages.
ReachOut Wireless™
subscribers hereby consent to accept/receive incoming text messages from time
to time from ReachOut Wireless™ related to certain mandatory aspects of theReachOut Wireless™
program as a condition to remaining eligible for the ReachOut Wireless™
program. ReachOut Wireless™ subscribers hereby acknowledge that incoming ReachOutWireless™
text messages will be charged as described above. ReachOut Wireless™
subscribers may opt out of accepting/receiving incoming text messages
from ReachOutWireless™ related to certain non-mandatory aspects of the ReachOut Wireless™
program by calling 1-877-870-9444. There is no charge to opt out of text
messaging.
Premium
SMS: Premium SMS is a text message to a designated "short
code" or buying or attempting to buy SMS services from anyone other
than ReachOut Wireless™ Premium SMS campaigns include activities such as
casting a vote, expressing your opinion, playing a game, subscribing to a
service, or interactive television programs. ReachOut Wireless™
does not generally participate in Premium SMS services or campaigns. You are
solely responsible for any charges incurred for Premium SMS services or
campaigns. Any text message sent to a "short code" will in all
likelihood not go through. Any charges you may incur as a result of any
attempts to participate in Premium SMS services or campaigns (not authorized
by ReachOutWireless™) whether you incur charges as deductions from your ReachOut Wireless™
minutes or from your credit card, are not refundable.
Data: The
rates to send or receive Data using your ReachOut Wireless™
handset is $1.25 per megabyte.
A $0.10
minimum account balance on the ReachOut Wireless™
plan is required to place or receive a call. 900/976 numbers are not available
with ReachOut Wireless™
ReachOut Wireless™
standard airtime charges apply to 800, 866, 877 and other toll-free calls
ReachOut Wireless™
allows Domestic Long Distance calls to be originated and terminated within the
50 United States.
A fee may
be charged for calls to add funds using a live customer service representative.
ReachOut Wireless™
Mobile to Mobile Minutes: Standard airtime charges apply to all Mobile to
Mobile calls (i.e. ReachOut Wireless™ to ReachOut Wireless™
calls).
Your ReachOut Wireless™
handset display does not indicate the rate you will be charged.
DISPUTES: YOU
MUST NOTIFY NEXUS IN WRITING WITHIN TWO MONTHS OR (90) DAYS, WHICHEVER COMES
FIRST, OF THE DATE OF ANY EVENT GIVING RISE TO ANY DISPUTE INCLUDING, BUT NOT
LIMITED TO, A DISPUTE OVER ANY CHARGES, ANY SERVICE PROVIDED, OR ANY EQUIPMENT
PROVIDED TO YOU, OR YOU WILL HAVE WAIVED YOUR RIGHT TO DISPUTE THE CHARGES (OR
SERVICES, OR EQUIPMENT) AND WAIVED YOUR RIGHT TO BRING, OR PARTICIPATE IN, ANY
LEGAL ACTION RAISING ANY SUCH DISPUTE. ALL DISPUTES MUST BE IN WRITING AND SENT

If your ReachOut Wireless™ is interrupted for 24 or more continuous hours by
a cause within Nexus' control, Nexus will issue you, upon written request,
either a credit equal to a pro-rata adjustment of any recurring charge (if
applicable) for the time period your ReachOutWireless™
service was unavailable, not to exceed the charges collected for the period of
interruption, or an extension of the expiration period. Nexus' liability to
any ReachOutWireless™ subscriber for service failures is limited solely to the
credit set forth above.
ReachOut Wireless™
service excludes all incidental or consequential damages, unless otherwise
provided by law. Some states do not allow the exclusion or limitation of
incidental or consequential damages.
DISPUTE
RESOLUTION BY BINDING ARBITRATION: By accepting delivery
and making a call on your ReachOut Wireless™ handset you
are agreeing to the condition that requires that certain disputes that may
arise between you the subscriber and Nexus be resolved through Binding
Arbitration instead of a court trial or in courts of general
jurisdiction. The sole remedy for any dispute shall be binding
arbitration on an individual basis, rather than by a jury trial or class
actions. Binding Arbitration limits the remedies available to you in the event
of a dispute. Binding Arbitration is on an individual basis exclusively and
class arbitrations and class actions are hereby excluded as a remedy.
By
accepting delivery and making a call on your ReachOut Wireless™
handset you agree that the parties (ReachOut Wireless™
and you the ReachOut Wireless™ subscriber) are each waiving the right to
a trial by jury or to participate in a class action and the Federal
Arbitration Act governs the interpretation and enforcement of any claim brought
by you. This binding arbitration provision shall survive termination of your
service with ReachOutWireless™ and you as the ReachOut Wireless™
subscriber agree to arbitrate all disputes and claims between the parties. This
agreement to arbitrate is intended to be broadly interpreted. It includes, but
is not limited to claims arising out of or based in contract, tort, statute,
fraud, misrepresentation, claims relating to advertising, or any other legal
theory and claims that are currently the subject of purported class action
litigation in which you are not a member of a certified class. The arbitrator
may award declaratory or injunctive relief only in favor of the individual
party seeking relief and only to the extent necessary to provide relief
warranted by that party's individual claim. YOU AND ReachOut Wireless™
AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS
INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED
CLASS OR REPRESENTATIVE PROCEEDING Further, unless both you and ReachOut Wireless™
agree otherwise, the arbitrator may not consolidate more than one person's
claims, and may not otherwise preside over any form of a representative or
class proceeding. Either party (ReachOut Wireless™
or you the ReachOutWireless™ subscriber) who intends to seek binding arbitration must
first send to the other, by certified mail, a written Notice of Dispute
("Notice"). The Notice to ReachOut Wireless™

The
Notice must (1) contain a description of the facts and basis of the claim or
dispute; and (2) the specific relief the party is seeking. If ReachOut Wireless™
and you do not reach an agreement to resolve the claim within 30 days after the
Notice is received, you or ReachOutWireless™
may commence a binding arbitration proceeding. During the binding arbitration, the
amount of any settlement offer made by either party shall not be disclosed to
the arbitrator until after the arbitrator determines the amount, if any, to
which the other party is entitled. The binding arbitration will be governed by
the Commercial Arbitration Rules and the Supplementary Procedures for Consumer
Related Disputes (collectively, "AAA Rules") of the American
Arbitration Association ("AAA") and will be administered by the AAA.
The AAA Rules are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by
writing to the Notice Address. The arbitrator is bound by these terms and
conditions. The only issues that are outside the scope of the arbitrator are
issues, if any relating to the scope and enforceability of the arbitration
provision. If the arbitrator finds that either the substance of the filer's
claim or the relief sought is frivolous or brought for an improper purpose (as
measured by the standards set forth in Federal Rule of Civil Procedure 11(b)),
then the payment of any fees will be governed by the AAA Rules.
LIMITATION
OF LIABILITY: NEXUS MAKES NO WARRANTY, EXPRESS OR IMPLIED, OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, OR
PERFORMANCE REGARDING ANY SERVICES OR GOODS, AND IN NO EVENT SHALL NEXUS BE
LIABLE, WHETHER OR NOT DUE TO ITS OWN NEGLIGENCE, for any: (a) act or omission
of a third party; (b) damage or injury caused by the use of service or device,
including use in a vehicle; (c) mistakes, omissions, interruptions, errors,
failures to transmit, delays or defects in the service provided by or through
us; (d) claim against you by third parties; (e) damage or injury caused by a
suspension or termination of service by Nexus; or (f) damage or injury caused
by failure or delay in connecting a call to 911 or any other emergency service.
Unless
applicable law precludes parties from contracting to so limit liability, and
provided such law does not discriminate against arbitration clauses, Nexus
shall not be liable for any indirect, special, punitive, incidental or
consequential losses or damages you or any third party may suffer by use of, or
inability to use, service or device provided by or through Nexus, including
loss of business or goodwill, revenue or profits, or claims of personal
injuries.
INDEMNITY: To
the full extent allowed by law, you hereby release, indemnify, and hold Nexus
and its officers, directors, employees and agents harmless from and against any
and all claims of any person or entity for damages of any nature arising in any
way from or relating to, directly or indirectly, service provided by Nexus or
any person's use thereof (including, but not limited to, vehicular damage and
personal injury), INCLUDING CLAIMS ARISING IN WHOLE OR IN PART FROM THE ALLEGED
NEGLIGENCE OF NEXUS. This obligation shall survive termination or expiration of
your service with Nexus.
SOME
STATES DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES OR LIMITS ON REMEDIES FOR
BREACH. THEREFORE, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
YOU MAY HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.
NEXUS
DOES NOT GUARANTEE UNINTERRUPTED SERVICE OR COVERAGE. NEXUS CANNOT ASSURE YOU
THAT IF A 911 CALL IS PLACED BY YOU WILL BE LOCATED. Limitations of liability set
forth herein govern unless prohibited by applicable law.
Service
may be interrupted, delayed or otherwise limited for a variety of reasons,
including environmental conditions, unavailability of radio frequency channels,
system capacity, priority access by National Security and Emergency
Preparedness personnel in the event of a disaster or emergency, coordination
with other systems, equipment modifications and repairs, and problems with the
facilities of interconnecting carriers.
ReachOut Wireless™
service blocks access to certain categories of numbers (e.g., 976, 900 and
international destinations) at the sole discretion of ReachOut Wireless™.
ReachOut Wireless™
may send you from time to time alert messages via SMS or email however there is
no guarantee you will receive them.
Nexus
also reserves the right to change or modify any of these ReachOut Wireless™
Terms and Conditions of Service at any time and at Nexus' sole discretion.
Your ReachOut Wireless™
account is non-transferrable.
ReachOut Wireless™
cards and other account refills are nontransferable and nonrefundable.
ReachOut Wireless™
Service is available as long as you have a positive account balance.
ReachOut Wireless™
Handset Requirements: A compatible phone is required for ReachOutWireless™.
Not all calling features work on all phones and in all areas.
Any
changes or modifications to these ReachOut Wireless™
Terms and Conditions of Service will be binding once posted on the ReachOut Wireless™
website found atwww.Reachoutmobile.com.
Service
Activation Fee: Effective April 1, 2012 the Service Activation Fee is waived
for all states.
Monthly
Lifeline Plans (except California and Oklahoma):
Under the ReachOut Wireless™ Wireless Lifeline
plan, qualified subscribers will be able to select from one of the following
service offerings:
Two
Hundred Fifty (250) Minute Plan: Includes
a free E911 compliant handset and 250 minutes of free airtime each month.
Minutes are "anytime" nationwide minutes and can be used for domestic
calls, including local or intrastate/interstate long distance calls. Unused
minutes do not carry over to the following month and will expire at the end of
the calendar month or thirty (30) day period (whichever comes first) in which
the minutes were loaded. Domestic SMS text Messaging will be available at a
rate of one minute of airtime for each text message sent or received.
International SMS text messages will be available at a rate of $0.20 for each
international text message sent or received.
One
Hundred Twenty-five (125) Minute Plan: Includes
a free E911 compliant handset and 125 minutes of free airtime each month.
Minutes are "anytime" nationwide minutes and can be used for domestic
calls, including local or intrastate/interstate long distance calls. Unused
minutes/SMS text messaging will carry over to the following month and will not
expire as long as the subscriber remains actively enrolled in the Company's
Lifeline program. Domestic SMS text messaging will be available at a rate of
one minute of airtime for each text message sent or received. International SMS
text messaging will be available at a rate of $0.20 for each international text
sent or received.
Sixty
Eight (68) Minute Plan: Includes
a free E911 compliant handset and 68 minutes of free airtime each month.
Minutes are "anytime" nationwide minutes and can be used for domestic
calls, including local or intrastate/interstate long distance calls. Unused
minutes/SMS text messaging will carry over to the following month and will not
expire as long as subscriber remains actively enrolled in the Lifeline program.
Domestic SMS text messaging will be available at a rate of one minute of
airtime for two text messages sent or received. International SMS text
messaging will be available at a rate of $0.20 for each international text sent
or received.
ReachOut Wireless™
subscribers can purchase additional bundles of minutes on a prepaid basis in
denominations of $3.00 (20 minutes), $5.00 (40 minutes), $10.00 (120 minutes),
$20.00 (300 minutes), $30.00 (500 minutes) and $50.00 (950 minutes).

California ReachOut Wireless™ subscribers have the ability to purchase refill
minutes on a prepaid basis in pre-set denominations of $3.00 (91 minutes),
$5.00 (152 minutes), $10.00 (304 minutes), $20.00 (607 minutes), $30.00 (910
minutes), and $50.00 (1,516 minutes), all billed at $0.33 per minute. All
additional airtime minutes are valid for 30 days from date of replenishment.
Monthly
Lifeline Plans (OKLAHOMA Only):
Three Hundred
Fifty (350) Minute Plan:
Includes a free E911 compliant handset and 350 minutes of
free airtime each month. Minutes are "anytime" nationwide minutes and
can be used for domestic calls, including local or intrastate/interstate long
distance calls. Unused minutes do not carry over to the following month and
will expire at the end of the calendar month or thirty (30) day period
(whichever comes first) in which the minutes were loaded. Domestic SMS text
Messaging will be available at a rate of one minute of airtime for each text
message sent or received. International SMS text messages will be available at
a rate of $0.20 for each international text message sent or received.
Unlimited
Talk Plan (Requires Monthly Recurring Charge of $39.99 per month):
Includes a free E911
compliant handset and unlimited voice minutes each month. Minutes are
"anytime" nationwide minutes and can be used for domestic calls,
including local or intrastate/interstate long distance calls. Unused minutes do
not carry over to the following month and will expire at the end of the
calendar month or thirty (30) day period (whichever comes first) in which the
minutes were loaded.
Unlimited
Talk & Text Additional Airtime Card (all states)
When purchased, the Unlimited Talk & Text additional airtime card will
provide exactly thirty (30) calendar days of service and will provide unlimited
local and domestic long distance calling, and unlimited text messaging.
Since ReachOut Wireless' wireless program is prepaid, all subscribers will
be required to purchase the card prior to obtaining the benefit of the
Unlimited Talk & Text additional airtime card. ReachOut Wireless™
subscribers may purchase the Unlimited Talk & Text additional airtime card
any time during the month. Once the ReachOut Wireless™
subscriber loads the Unlimited Talk & Text additional airtime card, the
subscriber will need to purchase a subsequent Unlimited Talk & Text
additional airtime card and load it on to their ReachOut Wireless™
account within thirty (30) days from the date the first Unlimited Talk &
Text additional airtime card was initially loaded ("expiration date")
in order to continue to receive Unlimited Talk & Text additional
airtime. ReachOut Wireless' subscribers may add additional minutes to their
account by purchasing additional airtime cards at participating retail outlets
or by making credit card purchases by calling 611 for free, or by calling ReachOut Wireless'™
toll free customer care number from their wireless phone or on-line at
www.Reachoutmobile.com.
Effective
April 1 2012, all ReachOut Wireless™ subscriber's federal Lifeline reimbursements will
change to a flat-rate $9.25 per line in all states. Additional support for
residents of Tribal lands may be available. A number change charge of $15.00
fee will be applied for a change of wireless telephone number initiated at the
request of the wireless subscriber.
Reachout Wireless’ Unlimited Plans may only be used for the following purposes: (a) person to person voice calls (b) text and picture messaging and (c) internet browsing and ordinary content downloads.
Reachout Wireless’ Unlimited Plans may not be used for certain unauthorized uses that adversely impact our service. Examples of unauthorized uses include, without limitation, the following: (i) continuous uninterrupted mobile to mobile or mobile to landline voice calls; (ii) automated text or picture messaging to another mobile device or e-mail address; (iii) uploading, downloading or streaming of uninterrupted continuous video; (iv) server devices or host computer applications, including, but not limited to, web camera posts or broadcasts, automatic data feeds, automated machine-to-machine connections or peer-to-peer (“P2P”) file sharing; or (v) as a substitute or backup for private lines or dedicated data connections.
A customer engaged in any unauthorized use of Reachout Wireless’ Service may have his/her Service throttled and/or terminated.
Customers will be provided notice and an opportunity to take corrective action with respect to unauthorized uses before their service is terminated.
National roaming capability may be discontinued or changed at any time without notice
Unlimited voice services may not be used for monitoring services, data transmission, transmission of broadcasts, transmission of recorded material, interconnection to other networks, telemarketing activity, autodialed calls, or robocalls. Reachout Wireless reserves the right to cancel or deactivate Service or reduce data throughput speeds in order to protect the Carrier’s network from harm due to any cause including, without limitation, the excessive and/or unauthorized use of Reachout Wireless Service.
Reachout Wireless reserves the right to limit throughput or amount of data transferred and to deny or terminate Service to anyone Reachout Wireless believes is using their Service in an unauthorized manner or whose usage, in Reachout Wireless’ sole discretion, adversely impacts a Carrier’s network or customer service levels.
Reachout Wireless will presume you are engaging in an unauthorized use in violation of these Terms and Conditions, if in Reachout Wireless’ sole discretion, you are placing an abnormally high number of calls, or repeatedly placing calls of unusually long duration, or if your talk, text or data usage is harmful or disruptive to the Carrier’s network or service levels.
If Reachout Wireless determines, in our sole discretion, that you are using your Service in violation of the Reachout Wireless Terms and Conditions or in any other manner that we deem to be unreasonable or excessive, we may terminate individual calls or data connections, terminate or reduce data throughput or terminate your Service, decline to renew your Service, or offer you a different Service plan with no unlimited usage component.
Reachout Wireless UNLIMITED PLAN FEATURES CANNOT BE USED FOR: (1) access to the Internet, intranets, or other data networks except as the device’s native applications and capabilities permit (excluding all Hotspot applications), (2) any applications that tether your phone to a laptop or personal computer other than for the use of Wireless Sync, or (3) any applications that allow your phone to act as an internet access point or Wi-Fi for other devices and computers.
Reachout Wireless may discontinue providing Service to you, discontinue your account, terminate data connections and/or reduce data throughput speeds for customers whose usage, in the sole judgment of Reachout Wireless: (1) appear likely to generate abnormally high call volumes or data usage and/or abnormally long average call lengths or data usage as compared to the usage of other Reachout Wireless customers or (2) may be harmful, disruptive, or interfere with the Carrier’s network, Reachout Wireless’ service or the ability to provide quality service to other customers. By initiating Service and placing or receiving calls, you acknowledge and agree to Reachout Wireless’ right to terminate your Service under these circumstances.
Reachout Wireless may modify or cancel any Service or take corrective action at any time without prior notice and for any reason, including but not limited to your violation of this agreement.
International
Long Distance: You may use your ReachOut Wireless™
phone to make international calls to landlines (including some cellular phones
in some countries) but additional per minute rates apply. The actual rates and
the available countries are subject to change without prior notice. (See
www.Reachoutmobile.com for available countries and details). Airtime deductions
for international calls begin the moment the International Long Distance
("ILD") access number is dialed and also applies to dropped calls,
misdialed numbers and busy destination numbers. When making international
calls, you may experience connection failures more frequently than calls made
within the United States. ReachOutWireless™ reserves the
right to block calls to any international location without notice, and to
suspend or terminate international calling capability without notice. Call
Forwarding is blocked to all international locations. ReachOut Wireless™
reserves the right to require subscribers, in order to complete an
international call, the requirement to first dial a toll free number; or enter
a "pound code" or a "short code" or a "star code"
in order to complete the call.
International
Calling: Per minute international long distance charges apply in
addition to regular airtime charges. Higher charges may apply to mobile
terminated calls in certain countries. International calling rates a subject to
change without notice.
ReachOut Wireless™
will not credit airtime minutes deducted for unsuccessful calls. You will not
be able to make or receive calls on your ReachOut Wireless™
phone when you are located outside of the 50 United States.
Adding
Additional Airtime: Adding Additional Airtime: Your ReachOut Wireless™
phone will only operate when you have airtime minutes/units/value available on
the ReachOut Wireless™ handset. If you run out of your free monthly
allotment of airtime, you may purchase and add airtime to your phone.
California
Recurring Airtime:
ReachOut Wireless™ traditional non-Lifeline California-only plans
consist of 250 minutes for a $16.00 a month plan; 500 minutes for $18.50 a
month; and 1000 minutes for $33.50 per month. If you have selected the $16.00 a
month plan and you are approved for Federal Lifeline by Cert A, the California Lifeline
Administrator, you will receive a Lifeline credit of $9.25. Additionally if you
have selected the $18.50 a month plan and if you are approved for Federal
Lifeline by Cert A the California Lifeline Administrator you will receive a
Lifeline credit of $9.25. Alternatively if you have selected the $33.50 a month
plan and if you are approved for Federal Lifeline by Cert A, the California
Lifeline Administrator, you will receive a Lifeline credit of $9.25.
With
all ReachOut Wireless™ California-only monthly plans the minutes do not
roll over. If you do not use the monthly minutes allotted under the
California-only plans, the minutes will not roll over to the next month.
Additional
Airtime Cards: ReachOut Wireless™ customers may purchase and use anyReachOut Wireless™
airtime cards, or obtain additional airtime directly through ReachOutWireless™ You add
airtime by entering the PIN obtained from a ReachOut Wireless™
airtime card. You must add your airtime to your ReachOut Wireless™
phone within one year from the date of purchase; otherwise the card/PIN expires
and you will not be able to add those minutes to your ReachOut Wireless™
phone; nor receive a refund for any unused minutes. Each Nexus airtime card
comes with a number of minutes and a service period that begins to run from the
day you add airtime to your ReachOut Wireless™
phone.
Any
airtime purchased and loaded on to a ReachOut Wireless™
Non-Lifeline Non-Government Assisted handset will be valid and available for
use for up to 90 days from the date the airtime value was loaded if no
additional airtime purchase(s) are loaded within the 90 day period from the
date the last airtime purchase was loaded. Failure to purchase and load
additional airtime within the 90 day period from the date the last airtime purchase
was loaded will result in loss of any unused airtime.
Maintaining
an active account: In order to keep your service active on the ReachOutWireless™
Non-Lifeline Non-Government Assisted, you must purchase and load airtime at
least once during any consecutive 120 day period. As explained above, airtime
expires 90 days from date of loading. If no additional airtime is loaded within
30 days after the 90 day expiration of your airtime (90 days + 30 days= 120
days), then your service on the ReachOutWireless™
Non-Lifeline Non-Government Assisted will be deactivated.
Once
deactivated ReachOut Wireless™ may also reassign your phone number to a different
user. If your ReachOut Wireless™ Non-Lifeline Non-Government Assisted phone number
is deactivated for non-use as described above, then a new phone number will be
assigned to you by ReachOut Wireless™ and all outstanding activation fees must be paid
prior to reactivation on the ReachOut Wireless™
Non-Lifeline Non-Government Assisted service.
For
California residents, purchase of additional airtime will be credited towards
the minimum monthly recurring fee in the following manner.

monthly recurring minutes that were credited with the purchase of additional

Bonus
Minutes: ReachOut Wireless™ may from time to time offer Bonus minutes on
minutes purchased via airtime card, PIN, or directly from ReachOut Wireless™
The free monthly allotment of ReachOut Wireless™
minutes received by the customer while enrolled in theReachOut Wireless™
program, will not increase in value/airtime with the purchase of any additional
airtime.
A fee may
apply to all the ReachOut Wireless™ rate plan changes.
Service
End Date: Is the last day of your ReachOut Wireless™
service period. Airtime minutes added to your ReachOut Wireless™
account do not expire if you elected to be on a rollover plan and
as long as your ReachOut Wireless™ account remains active and at least one airtime
transaction occurs during a consecutive sixty (60) day period. An Airtime
transaction can include, but is not limited to, per minute voice cellular call,
inbound SMS text message, outbound SMS text message, or data usage. Service End
Date can be calculated from (i) the date your ReachOut Wireless™
account became active; (ii) the date you placed or received the initial airtime
transaction on your ReachOut Wireless™ account; (iii)the receipt of the monthly allotment
of ReachOut Wireless™ plan airtime minutes; (iv) or the purchase or
addition of a ReachOut Wireless™ airtime card, or (v) the date you were determined
to be eligible for the ReachOut Wireless™ plan,
whichever can be conclusively determined byReachOut Wireless™
at its sole discretion.
If for
whatever reason your ReachOut Wireless™ service is
suspended within the initial (or subsequent twelve month renewal period, or any
subsequent twelve month renewal period thereafter) and subsequently restored
you will only receive the monthly minutes that you were entitled to receive
until being suspended but you will lose any minutes that you would have
received during your suspension period. If your ReachOut Wireless™
service is deactivated for whatever reason within the initial twelve month
period after initial enrollment, and you desire to re-activate your ReachOut Wireless™
service then you will need to re-qualify and re-enroll and no replacement or
reimbursement of unused minutes will be provided. If your account with ReachOut Wireless™
Lifeline service is deactivated for whatever reason within the initial twelve
month period after initial enrollment ReachOutWireless™
reserves the right to void any unused minutes on a Lifeline account, if any
unused minutes remain on that account. If for whatever reason Nexus were to
lose its ability to seek reimbursement for Lifeline, Nexus reserves the right
to void or cancel any unused minutes (and or monetary value) associated with Lifeline
subsidized service.
If you
fail to annually verify continued eligibility for the Lifeline program, fail to
re-qualify, failure to re-enroll in the ReachOut Wireless™
service and/or do not purchase any additional airtime minutes, then your ReachOut Wireless™
service will be deactivated and you will potentially lose your phone number,
even if you have minutes remaining.
The
purchase of any ReachOut Wireless™ airtime card is non-refundable. ReachOut Wireless™
airtime cards, airtime rate plans, and card denominations are subject to change
without prior notice.
Non-Usage
De-Enrollment and Deactivation: If a ReachOut Wireless™
subscriber exceeds sixty (60) days without any Usage (as defined in this
section), the ReachOut Wireless™ subscriber will be de-enrolled from the ReachOut Wireless™
Lifeline Program. " If you do not re-enroll or call ReachOut Wireless™
customer service within thirty(30) days of your de-enrollment, your phone
service will be deactivated and any airtime will be lost.
"Usage"
is defined as: (1) Completion of an outbound call; (2) Purchase of minutes fromReachOut Wireless™
to add to the subscriber's service plan; (3) Answering an incoming call from a
party other than ReachOut Wireless™ or ReachOut Wireless'
agent or representative; or (4) Responding to direct contact from ReachOut Wireless™
and confirming that the subscriber wants to continue receiving the Lifeline
service. In order to reactivate yourReachOut Wireless™
phone and re-enroll in the ReachOut Wireless™
Lifeline Program, you will need to call ReachOut Wireless™
customer service. Upon re-enrollment in the ReachOutWireless™
Lifeline Program, you will be provided your first entitlement of airtime for
the thirty (30) day period of time in which the service was reactivated.
MMS Data
Services: ReachOut Wireless™ is not responsible to provide Data Services. With
existing ReachOut Wireless™ phone models, subscribers are not able to download
ring tones, graphics, access information services such as news, weather and
sports ("Information Services") and utilize multi-media services
("MMS") (ringtones, graphics, Information Services and MMS are
collectively referred to as "Data Services"). Data Services are not
currently additional Services offered by the ReachOut Wireless™.
MMS Data service is only available in certain plans. ReachOut Wireless™'
services are provided solely for live dialogue between two individuals for
personal use consisting of person to person voice calls, text and picture
messaging (if available) and internet browsing and downloading of content (if
available). Other uses have the potential to disrupt reliable service to
other ReachOut Wireless' subscribers and/or have an impact on network
resources, so are therefore considered abuse of the service and are prohibited
uses pursuant to the company's terms & conditions and the company's
tariffs.
Such
prohibited uses include, but are not limited to utilization of ReachOut Wireless™
service for, connection to servers, connection to computers, connection to web
cameras, connection to machine-to-machine, connection to dedicated data
connections, telemarketing purposes, autodialing purposes, transmission of
broadcasts, transmission of recorded material, tethering purposes, continuous
mobile to mobile voice calls, continuous mobile to landline voice calls,
automated text or picture messaging to another mobile device, automated text or
picture messaging to another e-mail address, conference call purposes, use with
monitoring services, auto-redial purposes, streaming of audio or video data,
broadcast purposes, automatic data feed purposes, peer-to-peer (P2P) file
sharing purposes, backup for private line purposes, or any and all other
commercial uses.
ReachOut Wireless™
reserves the right to determine at the company's sole discretion that abuse and
prohibited use is taking place or evidence exists of a subscriber's placing
calls of unusually long duration. ReachOut Wireless™
reserves the right to prevent to such abuse and limit prohibited use by
terminating the usage and defaulting the ReachOut Wireless™
subscriber's service back to the standard pay-as-you-go prepaid plan (for
Non-Lifeline subscribers), the default 50 minute plan, 68 minute plan, 125
minute plan, or the 250 minute plan based upon the subscriber's account as initially
selected by the subscriber at time of initial activation, the most recent plan
change as elected by the ReachOut Wireless™ Lifeline
subscriber. Additionally, ReachOut Wireless™ reserves
the right to determine that abuse and prohibited use is taking place and
at ReachOut Wireless'™ sole discretion, may terminate or suspend service
accordingly. By ReachOut Wireless™ reserving the right to make changes to a
subscriber's account, at the company's sole discretion does not mean that ReachOutWireless™
has imposed any type of cap on the minutes and/or texts subscribers are allowed
to use. ReachOut Wireless™ monitors subscriber calling activity and the
company has the ability to determine indications of abuse and can limit,
restrict or terminate prohibited use.
As
a ReachOut Wireless™ subscriber, you are responsible for all calling
activity that occurs in your wireless account, and all content that you
transmit through a ReachOut Wireless™ handset. ReachOut Wireless™
reserves the right to, without notice, block access to certain categories of
numbers (e.g., 976, 900, chat lines, and certain international destinations) or
certain web sites if, in the company's sole discretion, ReachOut Wireless™
experiences excessive billing, collection, fraud problems, misuse of the
company's network, abnormal calling patterns, including repeated calls of an
extended duration or a large number of repetitive calls to a particular number
or numbers, or usage that may be harmful or disruptive to ReachOut Wireless'
systems or others subscriber's reasonable ability to use ReachOutWireless'™
services. ReachOut Wireless™ may, but does not have an obligation to, refuse to
transmit any information through ReachOut Wireless'™
service and may screen, filter and delete information prior to delivery to
any ReachOut Wireless™ subscriber at the company's sole discretion as
permitted by law.
In case
of damage or destruction of any of ReachOut Wireless™
equipment, handset or accessories due to the negligence or willful act of
the ReachOut Wireless™ subscriber, theReachOut Wireless™
subscriber will be held responsible for the cost of restoring the equipment,
handset or accessories to its original condition, or of replacing the
equipment, handset or accessories destroyed, or will be responsible to pay an
equipment replacement fee. ReachOut Wireless™
may suspend a subscriber's service while the subscriber effectuates replacement
or repair of the equipment, handset or accessories.
All ReachOut Wireless™
handset makes and models provided under the ReachOut Wireless™
program are selected and dispensed at the sole option of ReachOut Wireless.™
ReachOut Wireless™
recycles used phones.
ReachOut Wireless™
phone models will vary. ReachOut Wireless™ reserves
the right to substitute and/or replace any ReachOut Wireless™
equipment (including handsets) with otherReachOut Wireless™
equipment at any time and at the sole discretion of ReachOut Wireless.™
ReachOut Wireless™
subscribers acquire no proprietary interest in any telephone number assigned to
their ReachOut Wireless™ account. ReachOut Wireless™
subscribers must accept the telephone number assigned to the ReachOut Wireless™
account at the time of activation, which shall be assigned at the sole
discretion of ReachOut Wireless™.
Your ReachOut Wireless™
handset can only be used through ReachOut Wireless™
and cannot be activated with any other wireless or cellular service provider.
Any unauthorized use of yourReachOut Wireless™ handset,
including without limitation, any resale, unlocking and/or re-flashing of the handset
is unauthorized and may result in immediate discontinuance of service along
with legal action. Any attempt at tampering with or altering ReachOut Wireless™
phone or its software by unlocking, re-flashing, entering unauthorized PINs, or
engaging in any other unauthorized or illegal use of your ReachOut Wireless™
phone or the Service, or assisting others in such acts, including but not
limited to selling your ReachOut Wireless™ handsets or
minutes will be prosecuted to the fullest extent of the law. You hereby agree
that any illegal or unauthorized use or sale of your ReachOut Wireless™
phone or minutes shall entitle Nexus to recover liquidated damages from you in
an amount of not less than $5,000 per ReachOutWireless™
handset used in violation of this agreement.
ReachOut Wireless™
service is subject to certain limitations caused by many factors. Some of but
not all of the factors can include, system issues, equipment compatibility
issues, geographical limitations, atmospheric conditions, and other conditions
outside of the control ofReachOut Wireless™ Likewise, ReachOut Wireless™
service may be interrupted, quality degraded, blocked, or limited due to system
capacity limitations, technology migration or limitations imposed by the
Carrier, or due to but not limited to, equipment malfunction, outages,
modifications, repairs or other similar actions on the part of ReachOut Wireless™
to maintain its service offering. Neither Nexus, nor any Carrier, shall have
any liability whatsoever for service failures, outages or limitations of ReachOut Wireless™
service.
ReachOut Wireless™
cannot and does not warrant or guarantee availability of its wireless services
nor guarantee that ReachOut Wireless™ services will be provided without interruption.
ReachOut Wireless™
services are provided at Nexus' sole discretion.
ReachOut Wireless™
may modify or cancel any service or take corrective action at any time without
prior notice and for any reason, including but not limited to your violation ofReachOut Wireless™
terms and conditions.

CHARGES
YOU ARE RESPONSIBLE FOR: You are responsible for paying all charges
for or resulting from services provided hereunder. Charges may include, without
limitation: airtime, roamer, recurring monthly service, activation,
administrative, returned-check and late payment charges; network and other
surcharges; optional feature charges; toll, collect call and directory
assistance charges; any other charges or calls charged to your phone number;
and applicable taxes, surcharges and governmental fees, whether assessed
directly upon you or upon Nexus. Nexus reserves the right to add its own
charges to those charged by third parties. Payment for all charges is made in
advance and there is no proration of such charges. You hereby agree to pay for
incoming and outgoing calls to and from your phone. Additional charges may
apply for detailed information about your usage of services. Unless otherwise
specifically provided for hereunder any unused allotment of services from one
monthly period will not carry over to the next monthly period.
AIRTIME
AND OTHER MEASURED VOICE USAGE ("CHARGEABLE TIME") IS BILLED IN
FULL-MINUTE INCREMENTS AND IS ROUNDED UP TO THE NEXT FULL-MINUTE INCREMENT AT
THE END OF EACH CALL FOR CHARGING PURPOSES. NEXUS CHARGES A FULL MINUTE OF
AIRTIME USAGE FOR EVERY FRACTION OF THE LAST MINUTE OF AIRTIME USED ON EACH
WIRELESS CALL.
Chargeable
time begins for outgoing calls when you press SEND (or similar key) and for incoming
calls when a signal connection from the caller is established with our
facilities. Chargeable time ends after you press END (or similar key), but not
until your wireless telephone's signal or call disconnect is received by our
facilities and the call disconnect signal has been confirmed.
ACCOUNT
ACCESS: ReachOut Wireless™ may provide information about and to make changes
to ReachOut Wireless™ subscriber's accounts, including, but not limited
to, suspending, deactivating, adding new service, changing service, providing
information from my account to Customer Proprietary Network Information
("CPNI") upon the direction of any person able to provide
information ReachOut Wireless™ deems sufficient to identify you as the ReachOut Wireless™
subscriber.
Your
caller identification information (such as your name and phone number) may be
displayed on the equipment or bill of the person receiving your call; technical
limitations may, in some circumstances, prevent you from blocking the
transmission of caller identification information. You hereby consent to the
use by ReachOut Wireless™ or our authorized agents of regular mail,
predictive or autodialing equipment, email, text messaging, facsimile or other
reasonable means to contact you the ReachOut Wireless™
subscriber to advise you about our services or other matters ReachOut Wireless™
may believe to be of interest to you theReachOut Wireless™
subscriber. the ReachOut Wireless™ reserves the right to contact you the ReachOut Wireless™
subscriber by any means regarding customer service related notifications, or
other such information.
If you do
not want to accept these terms and conditions, do not activate a ReachOutWireless™
phone or use your ReachOut Wireless™ phone after you make a change to your account and
contact ReachOut Wireless™ at 1-877-870-9444.
Refund
Policy
You can
return or exchange almost everything within 14 days for a full refund. Simply
bring your item(s) to us with all contents and packaging, proof of purchase and
ID, and we will process your return or exchange.
All Final
Sale merchandise cannot be returned. Other nonreturnable purchases include
prepaid cards and airtime, completed services, and items returned that are
damaged or missing major contents.
If you
receive a product that is defective or that is not the product you ordered,
please return it to a Retail Store near you – and we'll arrange for a
replacement. If you would rather return the item by mail, please call us for
special instructions at 1-877-870-9444. We will cover all reasonable and
customary ground shipping fees.

Overview of the Lifeline Program
What is Lifeline Support?
Lifeline is a government assisted program that provides a monthly support that lowers the cost of monthly local wireline or wireless telephone service. An eligible customer may receive the federal Lifeline discount of $9.25 on
either a wireline or wireless connection, but the discount is available for only one telephone connection per household. Additional state support may be available in some states.
Only Lifeline eligible consumers may enroll in the program, and the benefit may not be transferred.
In order to qualify for and participate in the ReachOut Wireless™ Lifeline service offering, a person must meet certain state and federal eligibility requirements that can be unique to the particular state where the subscriber resides and the service is to be provided.
These state and federal eligibility requirements are based on several factors. Eligible subscribers can qualify for the Lifeline program one of two ways; Either through what is known as 1) Program Based Eligibility or 2) Income Based Eligibility.

- Supplemental Nutrition Assistance Program (Food Stamps)
- Supplemental Security Income (SSI)
- Federal Public Housing Assistance (Section 8)
- Low Income Home Energy Assistance Program (LIHEAP)

Generally under the income-based eligibility criteria, subscribers are eligible to receive Lifeline discounts if their total combined household income is at or below 135% of the Federal Poverty Guidelines established by the U.S. Government. Some states may permit consumers to qualify based on higher income levels.
INCOME BASED ELIGIBILITY: To demonstrate eligibility based upon income-based eligibility criteria only, please fax or mail the following information:
A signed ReachOut Wireless™ Lifeline application form signed and dated along with documentation demonstrating proof of income and total amount of household income for last year (Example: income tax return form, W2 form).

REQUIRED LIFELINE CERTIFICATIONS: All Applicants for Nexus' Lifeline service must certify under penalty of perjury that:
- He or she acknowledges that Lifeline is a government assistance program and that willfully making false statements to obtain the benefit can result in fines, imprisonment, de-enrollment or being barred from the program.
- He or she acknowledges that only Lifeline eligible consumers may enroll in the Lifeline Program.
- He or she acknowledges that only one Lifeline service is available per household, and that, to the best of his or her knowledge, no other person in his or her household is receiving a Lifeline service. (For purposes of Lifeline, a "household" is any individual or group of individuals who live together at the same address and share income and expenses.)
- He or she acknowledges that a household is not permitted to receive Lifeline benefits from multiple providers and that violation of this limitation constitutes a violation of the rules of the Federal Communications Commission and will result in de-enrollment from the Lifeline program. If he or she is participating in another Lifeline program at the time he or she applies for ReachOut Wireless™ Lifeline service, he or she agrees to cancel that Lifeline service with any other provider.
- He or she acknowledges that Lifeline is non-transferable and that he or she may not transfer my benefit to any other person.
- He or she acknowledges that providing false or fraudulent information to receive Lifeline benefits is punishable by law.
- He or she will notify ReachOut Wireless™ within 30 days if for any reason he or she no longer satisfies the criteria for receiving Lifeline services, such as no longer participating in any of the qualifying programs, or if he or she or a member of his or her household receives another Lifeline benefit.
- He or she acknowledges that he or she is may be required to re-certify to continued eligibility for Lifeline at any time, and that my failure to re-certify will result in de-enrollment and termination of Lifeline benefits.
- If he or she moves to a new address, he or she will provide the new address to ReachOut Wireless™ within 30 days.
- If he or she provided a temporary address, he or she is required to verify that temporary address every 90 days. If he or she does not provide verification within 30 days, he or she will be de-enrolled from the Lifeline program.
- He or she authorizes ReachOut Wireless™ to access any state or federal governmental records or database required to verify his or her statements herein and to confirm his or her continued eligibility for Lifeline and authorize social service agency representatives to discuss with and/or provide information to ReachOut Wireless verifying my participation in programs that qualify me for Lifeline. I also authorize ReachOut Wireless™ to release any records required for the administration of ReachOut Wireless'™ Lifeline program, including to the Universal Service Administrative Company (USAC), to be used in a Lifeline Program Database. He or she understands that the records are required to ensure the proper administration of the Lifeline program and that failure to provide consent will result in the applicant being denied the Lifeline service.
- He or she certifies that the information contained in his or her certification is true and correct to the best of his or her knowledge.
Upon written request, applicants who do not meet the eligibility requirements will be provided with the reason for non-eligibility.
ReachOut Wireless™ cannot accept your application for Lifeline service without the submission of your Social Security Number. ReachOut Wireless™ information is strictly confidential and will not be disclosed without your consent. If you submit your Social Security Number online your personal information is Secure Socket Layer (SSL) encrypted.
Annual Re-Certification Requirement
In accordance with FCC regulations, ReachOut Wireless™ must annually re-certify each of its Lifeline subscribers by either (1) querying the appropriate eligibility or income databases, confirming that the subscriber continues to meet
the program-based or income-based eligibility requirements for Lifeline and documenting the results of that review, or (2) obtaining a signed certification from the subscriber that meets FCC certification requirements. In order to continue
to receive Lifeline benefits, Lifeline subscribers must complete, and submit to ReachOut Wireless™, an annual re-certification form, which includes confirmation from the subscriber that the subscriber's household receives only one
Lifeline service and, to the best of the subscriber's knowledge, the subscriber's household is receiving no more than one Lifeline service. Lifeline subscribers will be contacted to re-certify his or her continuing eligibility for
Lifeline and if the subscriber fails to respond, he or she will be de-enrolled in the program. Every ReachOut Wireless™ service enrolled subscriber will be required to re-certify on an annual basis to remain eligible to receive benefits
under the ReachOut Wireless™ Lifeline program. Each ReachOut Wireless™ subscriber is required to re-certify for the Lifeline program pursuant to the appropriate federal and/or state rules associated with verification of Lifeline.
ReachOut Wireless™ reserves the right to determine at its sole discretion if a ReachOut Wireless™ subscriber meets the annual re-certification requirements and if the subscriber fails to re-certify for ReachOut Wireless™ service.
If ReachOut Wireless™ determines that a customer fails to re-certify for ReachOut Wireless™ service, such customer will immediately be deemed ineligible to participate in the ReachOut Wireless™ service and will no longer receive the
free monthly minutes. Once a customer no longer participates in the ReachOut Wireless™ Service (either by choice, disqualification, cancellation or termination), such customer may retain the ReachOut Wireless™ handset. Any ReachOut
Wireless™ subscriber who fails to meet the annual Re-certification requirement may remain as a ReachOut Wireless™ customer, however that subscriber will no longer be enrolled in the Lifeline program and receive free monthly minutes.
For applicants who successfully submit a ReachOut Wireless™ application if and when required and for applicants who meet the specific eligibility requirements, those approved applicants will receive a free cellular phone provided by ReachOut Wireless™ along with an allotment of airtime minutes each month for a period of twelve (12) consecutive months from the service start date.
ReachOut Wireless™ reserves the right to determine at its sole discretion whether or not an applicant meets the eligibility requirements to participate and/or continue to participate in the ReachOut Wireless™ service.
The actual amount of airtime minutes eligible subscribers will receive on a monthly basis varies from state to state. ReachOut Wireless™ reserves the right to change or modify, increase or decrease the actual amount of airtime minutes and eligible subscribers will receive on a monthly basis without notice.
Upon the request of a state and/or federal authority, a ReachOut Wireless™ customer's enrollment in the Lifeline program may also be cancelled. ReachOut Wireless™ reserves the right to cancel the enrollment of any customer and suspend or deactivate any ReachOut Wireless™ phone for any fraud related reasons.
OPTION TO DE-ENROLL. ReachOut Wireless™ subscribers have the ability to de-enroll from the Lifeline program at any time for any reason. Subscribers who choose to de-enroll from the ReachOut Wireless™ program
will no longer be entitled to receive the free monthly minutes. Subscribers who choose to voluntarily de-enroll from the Lifeline program will be required to re-qualify for the Lifeline pursuant to applicable federal and/or state rules.
Subscribers who choose to voluntarily de-enroll will be required to do so in writing and must provide ReachOut Wireless™ program sufficient information for ReachOut Wireless™ to conclusively determine the de-enrolling

SUPPORTED SERVICES Voice grade access to the Public Switched Telecommunications Network ("PSTN") is a functionality that enables a subscriber of telecommunications services to transmit voice communications, including signaling the network that the caller wishes to place a call, and to receive voice communications, including receiving a signal indicating there is an incoming call in a bandwidth, at a minimum, between 300 and 3,000 Hertz. Nexus service provides wireless access to the Public Switched Network.
Access to 911 and E911 Emergency Service: Access to Emergency Service is a service that permits a subscriber, by dialing the three-digit code 911, to call emergency services through a Public Service Access Point (PSAP) operated by local government.
Toll Limitation Service: Nexus subscribers have the optional ability to use their service to complete a long distance call or toll call in an amount of service that limits the amount of service to which they have already paid.
One subscriber per household rule: ReachOut Wireless™ will follow any established FCC or state Public Service Commission procedures to comply with the "one-per-qualifying subscriber per household rule" for Lifeline support. ReachOut Wireless™ will make available state-specific subscriber data, including name, address, to the Universal Service Administrative Company ("USAC") and to any state public utility commission as required for the purpose of permitting USAC or the state public utility commission to determine whether an existing Lifeline subscriber receives Lifeline service from another carrier. ReachOut Wireless™ will promptly investigate any notification that it receives from USAC or state public utility commission that one of its subscribers already receives Lifeline service from another carrier. Should investigation by ReachOut Wireless™ conclude that the subscriber receives Lifeline services from another carrier in violation of the FCC regulations, or if otherwise directed by USAC or the state Public Regulatory commission, ReachOut Wireless™ will immediately notify the subscriber and deactivate Lifeline services
Penalties for Fraud: As a ReachOut Wireless™ subscriber to Nexus Lifeline program, your Lifeline service and the resultant Lifeline subsidies may be terminated for various factors, including but not limited to a request to de-enroll your Lifeline benefits originating from either a federal and/or state authority. Please be advised, while as an active ReachOut Wireless™ subscriber to Nexus Lifeline program, you will be in VIOLATION OF FEDERAL AND STATE LAW if you attempt to engage in activities that amounts to TRANSFERRING, CONVEYING, SELLING OR GIVING AWAY a ReachOut Wireless™ HANDSET that is active and contains Lifeline subsidized minutes to someone other than the person that applied for the handset/service, OR CONVEYING, SELLING OR GIVING AWAY ReachOut Wireless™ LIFELINE-SUBSIDIZED SERVICE PROVIDED TO YOU, A LIFELINE END-USER, BY NEXUS COMMUNICATIONS, INC. to anybody. How do I apply?
Individuals claiming program-based eligibility must certify, under penalty of perjury, their eligibility through participation in one of the programs listed above and must provide acceptable proof of current
enrollment in at least one of the qualifying programs.
Individuals claiming income-based eligibility must sign a form certifying, under penalty of perjury, their total household income and the number of people in their household. In addition, customers must present acceptable documentation of income which includes:
- the prior year's state, federal, or tribal tax return
- current income statement from an employer or paycheck stub
- a Social Security statement of benefits, Veterans Administration statement of benefits, or a retirement/pension statement of benefits
- an Unemployment/Worker's Compensation statement of benefits
- federal or tribal notice letter of participation in General Assistance
- a divorce decree, child support, or other official document
If documentation that does not cover a full year is used to as proof of income, you must present three consecutive months' worth of the same types of document within that calendar year.

What is ReachOut WirelessTM
California LifeLine wireless service for California residents?
ReachOut WirelessTM
offers California LifeLine wireless service supported by the Federal Lifeline
and California LifeLine Programs. These programs provide discounts on monthly telephone
service to eligible households. The discounts can total up to $21.90 per month.
Approval from the California LifeLine Administrator is needed before getting
discounts under either of the programs.
Only one discount per household address is allowed,
except that the California LifeLine discount will be provided on two lines to
Deaf and Disabled Telecommunications Program participants or teletypewriter (TDD/TTY)
users. Therefore, unless the special
exception applies, if multiple wireless telephones are used by members of a
household, the discount can only be for one of these phones. Additionally, if members
of a household use both wireless telephone(s) and traditional, wireline
telephone(s), the discount can either be for one of the wireless telephones or
one of the traditional, wireline telephone lines, but not both.
What is a “household”?
For purposes of determining eligibility
for California LifeLine telephone service, a "household" is any individual or group
of individuals who live together at the same address and share income and
expenses. The household for which you are requesting government assisted
telephone service must be your primary residence.
How can I qualify for
ReachOut WirelessTM California LifeLine wireless service?
There are two ways to qualify.
You may qualify by using Method 1 Program-Based OR Method 2 Income-Based.

How
can I apply for ReachOut WirelessTM
California LifeLine wireless service?
ReachOut WirelessTM
will help you apply when you request wireless service, either at one of our
retail locations or by contacting us on line at www.reachoutmobile.com or by telephone at 1-877-777-1914. You will need
to provide us with certain identifying information, including the last four digits
of your social security number, and if you are not already enrolled under the
federal Lifeline or California LifeLine program with another service provider,
you will also need to provide us with proof of eligibility. We will provide all
of your information and documentation to the California LifeLine Administrator.
Acceptable documentation of
program based eligibility includes: (1) the current or prior year's statement
of benefits from a qualifying state, federal or Tribal program; (2) a notice
letter of participation in a qualifying state, federal or Tribal program; (3)
program participation document (such as a Supplemental Nutrition Assistance
Program (SNAP) electronic benefit transfer card or Medicaid participation card,
or a copy thereof with participant’s name
clearly visible); and (4) another official document evidencing
participation in a qualifying state, federal or Tribal program.
Acceptable documentation of
income based eligibility includes (1) the front page of the prior year's state,
federal, or Tribal tax return; (2) a current income statement from an employer
or paycheck stubs for 3 consecutive months during the past 12 months; (3) a
statement of benefits from Social Security, Veterans Administration, retirement/pension,
or Unemployment/Worker's Compensation ; (4) federal or Tribal notice letter of
participation in General Assistance, spousal support and child support orders;
and (5) other official documents containing income information.
You may also choose to
complete all or a portion of the application process without assistance from
us. In that case, within a week after requesting service, you will be mailed an
Application Form with a Personal Identification Number (PIN). In order to
receive California LifeLine service, you must complete, sign, and submit the
application to the California LifeLine Administrator along with any required
income or program eligibility documents before the due date. You may also apply
online. Follow the instructions in the application to apply online. Please be
sure to sign your application if you are mailing it in. If you are submitting
your application by mail, please be sure to send your completed and signed Application
Form to:

Once your application is
approved, the California LifeLine Administrator will notify us and you, so that
your California LifeLine wireless service can be activated.
How long can I keep ReachOut
WirelessTM California LifeLine wireless service?
You will need to renew each
year to keep California LifeLine wireless service. The California LifeLine
Administrator will automatically send you a Renewal Form prior to the anniversary
date of your service. You can remain on ReachOut WirelessTM California
LifeLine wireless service by making sure you fill out and submit the Renewal
Form before the due date. If you do not renew, you will lose your discounts and
will be required to pay the regular, undiscounted rates for your wireless
service until you reapply for California LifeLine service and your application
is approved.
Your discounts will also be
discontinued when you no longer meet the eligibility requirements. You must
notify us or the California LifeLine Administrator within thirty days if you no
longer meet the eligibility requirements. If you do not return the completed Renewal
Form on time or we are notified by you or the California LifeLine Administrator
that you are ineligible, ReachOut WirelessTM will stop providing
discounted service to you. If your permanent residence changes, you must notify
us within 30 days. If you are living in a temporary residence, you must notify
us when you change your residence or every ninety days if your residence has
not changed.
Can I still get California
LifeLine wireless or wireline telephone service if I change providers?
Yes, you can keep getting California
LifeLine wireless or wireline telephone service even if you change providers;
however, the prices for services may differ from company to company. If you disconnect
your existing service before selecting a new provider, you have 30 days after
disconnecting service to let your new provider know that you want California
LifeLine service. Then, the California LifeLine Administrator will simply
transfer your eligibility for California LifeLine service to the new service
provider and you will not need to re-apply. You do not need to notify your
existing provider that you are changing to a new provider of California
LifeLine service. However, unless you want to continue to receive service from
your existing provider at non-discounted rates, make sure that you actually
cancel your service with your existing provider after switching to a new provider.
When will I receive California
LifeLine discounts on my ReachOut WirelessTM Service?
You will receive the discounts
only after the California LifeLine Administrator has notified Reachout WirelessTM
that you are eligible and you have completed an outbound call after having been
notified of your eligibility.
If you are a new applicant for
California LifeLine services, the California LifeLine Administrator must first
determine that the Application Form is complete and correct and that your
eligibility is properly verified.
Once you are approved to
receive the discounted service, you will begin to receive the discounts as of
the date of the first outbound call that you make following the eligibility
determination.
Will the discounts be
automatically applied as soon as I call ReachOut WirelessTM to begin
the application process?
No, you will have to wait for
the California LifeLine Administrator to notify ReachOut WirelessTM
of your eligibility. In some cases, ReachOut WirelessTM receives
notifications of eligibility almost immediately. In other cases, there may be a
significant delay even after the completed application and all documentation of
eligibility is submitted by ReachOut WirelessTM.
What are my choices of

Reachout WirelessTM
offers free handsets of varying makes and models. Handsets are refurbished and
subject to a limited, thirty-day warranty. Handsets may only be used with
Reachout WirelessTM service and cannot be activated with any other
wireless provider. All Reachout WirelessTM subscribers may also
purchase upgraded handsets, with no differentiation between LifeLine and other

What terms and conditions
apply to Reachout WirelessTM California LifeLine Wireless Service
and do I have to sign a contract?
Reachout WirelessTM
offers California LifeLine wireless service on a prepaid basis, with never any
requirement to sign a term service contract. You may always discontinue service
for any reason at any time without penalty. Reachout WirelessTM does
not require Reachout WirelessTM California LifeLine wireless
customers to pay service deposits or activation fees, and does not impose early
termination charges. The terms and conditions of service, which govern all
aspects of Reachout WirelessTM service and your rights and
obligations as a Reachout WirelessTM subscriber, are available
before and after service activation on the Reachout WirelessTM
website at www.reachoutmobile.com. Written copies of the terms
and conditions are available before activation at retail locations where
Reachout WirelessTM California LifeLine service is sold and at
certain agencies or community-based organizations (CBOs) that are helping inform
California residents of the availability of California LifeLine service. A
written copy of the current terms and conditions are provided in writing to
each subscriber at the time of service activation; however, the terms and
conditions may change from time to time. Therefore, it is always important to
check the Reachout WirelessTM website for the most recently-updated terms
and conditions.
Are there any service issues
related to wireless service?
Yes. It is very important to
Reachout WirelessTM that you
understand that there are potential coverage and service quality issues you may
encounter if you select wireless service instead of traditional wireline (landline)
service.
Reachout WirelessTM
service uses radio transmissions and is therefore affected by various limitations.
Coverage is not available everywhere. Quality of service may be affected by
conditions beyond Reachout WirelessTM control, including
atmospheric, geographic, or topographic conditions, or if your handset is
damaged. We do not warrant or guarantee that service will be available at any
specific time or geographic location, or that service will be provided without
interruption. We may give credit for continuous service interruption of more
than 24 hours on a case-by-case basis, if such interruption was reasonably
within our control. The service coverage map is located on our website reachoutwireless.com.
Please be aware however that the coverage map is an estimate of our coverage
areas. Estimating wireless coverage and signal strength is not an exact
science. There are gaps in coverage within our estimated coverage areas that,
along with other factors both within and beyond Reachout Wireless’ control, may
result in service interruptions, slower data speeds, or lower quality of
service. Even when conditions are optimal, service will not always be available
at all times or without interruption. For example, if a cellphone transmitter
station loses commercial or back-up power, you may not be able to make a call
even if your handset is fully charged and you are in your residence or another
location where you can usually make calls.
Can I rely on wireless
service in an emergency?
Reachout WirelessTM
service includes free, unlimited access to 911 emergency services in compliance
with current state and federal laws. However, you must be aware that wireless
service may not always work well or even be available in an emergency.
If you take the handset with
you when you are away from your residence, anyone who remains in your residence
while you are away may not have the ability to dial 911 in an emergency.
Whether you are inside or
outside your residence, poor mobile reception resulting from weather
conditions, terrain, or gaps in service coverage may prevent you from
completing an emergency 911 call. You also need to be aware that in order for
your wireless service to work properly, the battery for the handset must be
charged. If there is a prolonged power outage, you may not be able to keep your
handset charged. Wireless subscribers are not being able to make or receive any
calls if the handset is dead. If your handset battery is dead, you will not
have the ability to dial 911 in an emergency.
Thus, there is no assurance
that if you try to make a 911 call, it will be completed. Therefore you should
never solely rely on your mobile phone for emergency calls, such as to 911.
Also, even if you complete a
911 call, emergency response personnel might not be able to determine your
location. Wireless handsets can often be located using satellite signals or
other special wireless technologies. However, the same types of conditions that
can interfere with your ability to complete wireless calls can also interfere
with these handset locating capabilities. For example, although you may be able
to make an emergency call while indoors, your handset may not be able to
connect to the satellite signal that is needed to locate you. Also, some
emergency response agencies may not have the ability to utilize wireless
locator technologies.
Therefore, you should always
be prepared to provide your actual location when making an emergency call.
What can I do if I cannot
get a good connection to wireless service in my residence or other location?
Reachout WirelessTM
California LifeLine wireless customers are entitled to a voice-grade connection
to the public telephone network. If you cannot obtain a voice-grade connection,
you should notify Reachout WirelessTM immediately. We are required
by California regulations to try to restore service. You may discontinue service
without penalty if we cannot do so. In fact, you may discontinue service at any
other time, for any reason, without penalty. However, if you discontinue service you will not be entitled to a refund
for unused airtime under any plan or card.
Are there other potential
disadvantages of wireless service?
While for many subscribers, Reachout WirelessTM service provides very substantial
advantages over traditional wireline service, we want you to be informed of
potential disadvantages of subscribing to California LifeLine wireless service instead
of California LifeLine wireline service. Features that are available under wireline
plans that may not be available with wireless service include the following:
All incoming calls are free with local wireline
service. Under wireless calling plans, Inbound calls are treated the same as
outbound calls. So unless an unlimited calling plan is selected, inbound calls
are not free.
Wireline subscribers receive a free directory
listing. Publicly available listings of wireless telephone numbers are not
available.
Wireline subscribers receive a free white pages
telephone directory. Wireless carriers do not provide free white pages telephone directories.
Wireline subscribers receive free Access to 800 or
800-like toll-free services. 800 or 800-like toll-free calls are treated the same as other calls
under wireless calling plans. So, unless an unlimited calling plan is selected,
800 or 800-like toll-free calls are not free.
Wireline subscribers receive free access to 211,
311, 511, and 811 calling. Calls to 211, 311, 511, and 811 are treated the same as other calls under some
wireless calling plans. So unless a Reachout WirelessTM 1000 minute
or unlimited plan is selected, calls to 211, 311, 511, and 811 are not
free.
Wireline subscribers may obtain free toll blocking
service. This is not available with wireless service. However, wireless service
provides uniform pricing for local and non-international long distance calls.

- An Unemployment/Workmen's Compensation statement of benefits
- Federal or tribal notice letter of participation in General Assistance.
- A divorce decree, child support, or other official document.
If documentation that does not cover a full year is used to as proof of income, you must present three consecutive months' worth of the same types of document within that calendar year.

How do I apply?
To demonstrate eligibility through participation in one of the qualifying needs-based assistance programs, the name of the subscriber applying for Nexus' Lifeline Service must appear on the list provided by
